Summary

Lawyers like to think we have a solid handle on what jurors want to hear about our client’s TBI case. While we are probably about 70% accurate, what if the 30% portion where we are not accurate changes the outcome of the trial? Gerry Spence once said there are three stories in the courtroom-the plaintiff’s story, the defendant’s story, and the jury’s story. Our job as lawyers is to show, as much as possible, how our client’s story aligns with the jury’s perceived story of the case, so the defendant’s story is the outlier.

With information gleaned from focus groups in all sorts of TBI cases and from speaking to jurors in TBI cases he has tried, Scott has developed a list of what every plaintiff’s lawyer needs to know about the power of people’s belief systems and the impact on TBI cases. Scott will share with you what he’s learned, using video clips from actual focus groups to demonstrate the power of belief systems to shape jurors’ perceptions of the case and the importance of showing the jury how your client’s story aligns with their perceived story of the case.
